2008 Company81 Design a T-Shirt Contest
OFFICIAL RULES
The "2008 Company81 Design a T-Shirt" contest (the "Contest") starts at 9:00:00 am Eastern Time ("ET") on 3/31/08 and ends at 11:59:59 pm ET on 6/30/08. The sponsor of this Contest Is Company 81 Inc, 31 W 34th St 3rd Fl, NY, NY 10001. (the "Sponsor"). This Contest is subject to these Official Rules, and by entering, all participants agree to be bound by these rules, and the decisions of Sponsor which are final and binding in all respects.
HOW TO ENTER ONLINE VIA THE ENTRY SITE: Beginning at 9:00:00 am ET on 3/31/08, you may enter the Contest online at http://www.company81.com by providing the information and photos required. Once you have completed the entry process according to an entry method stated above, click the "Submit" button to submit your completed entry.
WINNER SELECTION: One winner will be selected by the Company 81 creative team. The design will be featured on the Company 81 website. Winner will be selected on the basis of originality, creativity and relevance to Sponsor. By submitting an entry, you irrevocably transfer and assign to Sponsor all right, title and interest in your entry in any and all media, whether now known or hereafter created, in perpetuity throughout the world. The rights granted hereunder shall extend to all entrants, whether or not selected as winner.
Note: By entering the contest, you allow Company 81 to feature both your personal information and designs on the Company 81 website. Company 81 is not responsible for misrepresented designs or personal information. All entries become property of Sponsor and will not be returned. Submission of entry constitutes your consent to transfer all right, title and interest, including the copyright, to your entry to Sponsor. You must have all rights in your entry. Your entry must not infringe on the rights of any third party and must be suitable for publication. Sponsor reserves the right to disqualify any entry that may be fraudulent, that may infringe on the rights of others, to be incomplete, vulgar, obscene, or unsuitable for publication. Sponsor may reject any entry submitted in violation of the official rules.
By submitting an entry, you grant to Sponsor the right, except where prohibited by law, to use your name, likeness, image, entry, biographical information for advertising and promotional purposes, without compensation. You shall have no right of approval, and no claim arising out of any use, alternation, blurring, or use in composite form of your entry, name, picture or information.
PRIZE: The winning T-Shirt will become part of a future collection and may be named after the designer.
ELIGIBILITY: Open to legal residents of the 50 US incl. DC, 18 years of age and older. This Contest is governed by US law. Employees of Sponsor, its parent, subsidiaries, affiliates and agencies involved in the administration of this Contest are not eligible to participate.
LIMITATIONS ON LIABILITY: Releasees shall not be liable to winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor's sole control. Winner will be required to execute an Affidavit of Eligibility, Liability and publicity release, unless prohibited by law.
GENERAL: If for any reason this Contest is not capable of running as planned, or if this Contest or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Contest and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor's sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsor reserves the right, at their sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Contest or any portion thereof. In the event this Contest is cancelled, the Sponsor will conduct a random drawing to award all prizes from among all eligible, non-suspect entries received prior to the time of the action or event warranting such cancellation. If such cancellation, termination, modification, or suspension occurs, notification will be posted at the Entry Site. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE (INCLUDING THE ENTRY SITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. If a dispute arises about who submitted an entry on the Entry Site, the entry will be deemed submitted by the authorized account holder of the e-mail account entered. The authorized account holder is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and that all eligibility requirements are met.
